Small Claims, Big Preparation: Winning Without an Attorney

October 1, 20266 min read

Small claims court is the friendliest courtroom in New Hampshire — friendly, that is, to people who arrive prepared.

Before you file

Send a clear written demand with a deadline. Some disputes end here, and a paper trail strengthens everything after.

Build an evidence binder

One binder, chronological: contract or agreement, invoices, payment records, correspondence, photos. Tab everything. A judge who can follow your binder in two minutes is a judge leaning your way.

Rehearse the story in three beats

  1. The deal — what was agreed.
  2. The breach — what went wrong, with dates and amounts.
  3. The ask — the exact amount and why it's right.

On hearing day

Arrive early, dress like it matters, and bring two copies of everything. Answer only the question asked. Refer the judge to your tabs: "That's Exhibit 3, Your Honor."

Small claims caps may change — verify the current limit on the New Hampshire Judicial Branch site before you file.
